265 21 CaringorStarving?TheCaseofClaireConroy RichardA.McCormick,SJ ClaireConroywasaneighty-four-year-oldnursinghomeresident.Shesuffered fromirreversiblephysicalandmentalimpairmentsincludingarteriosclerotic heartdisease,diabetes,andhypertension.Shecouldneitherspeaknorswallow andwasfedbyanasogastrictube.Hermovementswereverylimitedthoughshe couldsmileormoaninresponsetosomestimuli.Shewasrestrictedtoasemifetal positionandlackedcontrolofherexcretoryfunctions.ThomasC.Whittemore ,MissConroy’snephewandguardian,requestedthatthenasogastrictube beremovedfromhisawakebutseverelydementedaunt.Theapplicationwas opposedbyMissConroy’sguardian“adlitem”(forpurposesoflitigation). Attrial,twophysicianstestifiedthatMissConroywoulddieofdehydration inaboutaweekafterremovalofthenasogastrictube.Theyalsoconcurredin theopinionthatherdeathwouldbepainful.Onephysicianregardedthenasogastric feedingasoptionalmedicaltreatment.MissConroy’sownphysician, however,believedthatremovalofthetubewouldbeunacceptablemedicalpractice .Thetrialcourt(JudgeReginaldStanton,Feb.2,1983)decidedtopermit removalofthetubebecauseMissConroy’slifehadbecomeintolerablyand permanentlyburdensome. ThisdecisionwasappealedbyMissConroy’sguardianadlitem,butshedied whiletheappealwaspending.However,theappellatedivisionconsideredthe mattertooimportanttobeleftunresolved.Itreversedthetrialcourt’sjudgment andstatedthatremovalofthenasogastrictubewouldbetantamountto killingher.Aguardian’sdecision,thecourtargued,mayneverbeusedtowithhold nourishmentfromanincompetentpatient.Asthecourtwordedit:“The trialjudgeauthorizedeuthanasia[homicide]....Ifthetrialjudge’sorderhad beenenforced,Conroywouldnothavediedastheresultofanexistingmedical condition,butrathershewouldhavedied,andpainfullyso,astheresultofa newandindependentcondition:dehydrationandstarvation.Thusshewould havebeenactivelykilledbyindependentmeans.” Mr.WhittemoretookthequestiontotheNewJerseySupremeCourt,the samecourtthathaddecidedtheKarenQuinlancase.Thecourtreleasedits decisionJan.17,1985.Afteracknowledgingtherightofacompetentadult todeclinemedicaltreatment—arightembracedwithinthecommon-lawright ofself-determination—thecourtaddressedtherightsoftheincompetent.It noted:“Therightofanadultwho,likeClaireConroy,wasoncecompetent,to determinethecourseofhermedicaltreatmentremainsintactevenwhensheis nolongerabletoassertthatrightortoappreciateitseffectuation.” Clearlyasubstitutedecision-makerorproxymustbecalledupontofunction atthispoint.Mayaproxyeverdecidethatlife-sustainingtreatmentmay bewithheldorwithdrawnfromanincompetentbutnotcomatosepatient?The courtrespondedintheaffirmativeandproposedthreetestsorstandardscorresponding tothreedifferentsituations.First,thereisthe“subjectivestandard,” underwhichlife-sustainingtreatmentmaybewithheldorwithdrawn“whenit isclearthattheparticularpatientwouldhaverefusedthetreatmentunderthe circumstancesinvolved”(emphasisadded).Thisclearintentcanbeconcluded fromwrittendirectives(livingwill)ororalstatementsmadetofamily,friends orhealthproviders.Itmightalsoderivefromadurablepowerofattorneyor appointmentofaproxywithauthorizationtomakemedicaldecisionsonthe patient’sbehalf. Second,thereisthe“limitedobjectivetest.”Life-sustainingtreatmentmay bewithheldorwithdrawnfromapatientlikeClaireConroywhenthereistrustworthy evidencethatthepatientwouldhaverefusedthetreatmentandtheproxy issatisfiedthattheburdensofthepatient’scontinuedlifewiththetreatment outweighthebenefitsofthatlifeforthepatient.
