EUR 34,80 Pope Benedict XVI begins the motu proprio Summorum pontificum with motives for promulgating norms on the extraordinary form of the Roman Rite. He indicates that the concern of the Supreme Pontiffs has been for a worthy worship to ensure that the Church of Christ offers a fitting rite to the Divine Majesty since the Church’s lex orandi corresponds to its lex credendi. The present study is the revised dissertation which the author had written to obtain the licentiate in canon law at the KatholischTheologische Fakultät of the Ludwig-Maximilians-Universität München in 2009. The author offers a commentary on the motu proprio with the intention that the text, understood according to the mind of the supreme Legislator, should be received by the Church as the legal community . Methodologically, the rules of the CIC are to be applied to interpret Summorum pontificum. This study begins with a preface, a list of abbreviations, and a list of sources and literature. Then, the author devotes three chapters to the main themes of Summorum pontificum. In chapter one the author describes the theme of his work and the approach of his investigation. He examines the document in the context of theological questions: Is there a new theology due to the development of our understanding of the Mass? Is a liturgical reform needed? What is the concern of the popes? How do the lex orandi and the lex credendi correspond to each other? Finally, he describes the hermeneutic of continuity: there is growth and progress of the liturgy, but no rupture. Chapter two analyzes the motu proprio itself. After a general description and some critical observations on the structure of the document, the author describes in order the twelve articles of Summorum pontificum. He explains the general intention of each norm, certain important aspects of each norm, and key words used throughout the motu proprio. His starting point is the Latin text in the light of which he offers interpretations. Chapter three is a conclusion which offers also an outlook on the effects of Summorum pontificum on the liturgy. The author offers a critical evaluation of each article of the motu proprio, indicating different possibilities in the document’s interpretation and various opinions of well-known canonists. The scientific analysis of the motu proprio is excellent and offers possibilities for further study.
