Abstract

This essay is directed toward providing a political understanding of American prisons, both foreign and domestic. In light of revelations of abuse and torture at U.S. prisons on foreign soil and the mass incarceration of Americans at home, this essay focuses attention on these grave challenges to U.S. democracy in the 21st century, to encourage us to consider how the treatment of American prisoners at home and abroad can be brought in line with the U.S. Constitution, international law, and the principles of justice.
