Abstract

On impose aux jeunes contrevenants des conditions de mise en liberté sous caution afin de s'assurer qu'ils reviennent devant les tribunaux et de réduire les risques pour le public en restreignant leurs actions dans la collectivité.Toutefois, ces conditions ont parfois une conséquence imprévue : l'ajout d'accusations au criminel lorsqu'un jeune n'a pas respecté l'ordonnance du tribunal. Dans cette étude, on a suivi un échantillon aléatoire de (N = 225) jeunes détenus temporairement sous enquête sur le cautionnement, puis libérés par un grand tribunal de Toronto. Même si ultimement près de la moitié des accusations associées à l'enquête sur le cautionnement ont été retirées, près du tiers des jeunes ont été accusés d'avoir manqué aux conditions de leur mise en liberté. Ceux qui faisaient l'objet d'une ordonnance de cautionnement durant une période relativement longue et qui avaient de nombreuses conditions de mise en liberté étaient plus susceptibles d'accumuler de nouvelles accusations pour non-respect des conditions.

Abstract

Bail conditions are placed on youths in an effort to ensure they return to court and to reduce danger to the public by constraining the behaviour of the accused in the community. These conditions, however, may have the unintended consequence of setting youths up to accumulate further criminal charges of failing to comply with a court order. The present study tracked a random sample (N = 225) of youths who were held for bail hearings and ultimately released from a large Toronto court. Although ultimately close to half the sample had all charges related to the bail hearing withdrawn, close to a third of the sample were charged with failing to comply with conditions of release. Those who were subject to a bail order for a relatively long time and had numerous bail conditions were most likely to accumulate new charges of failing to comply.
