APPENDIX II I Protectorate Agreement with the Sultan of Brunei, September iyth, 1888* Whereas, Sulta n Hashi m Jalilu l Ala m Akamadin , Sulta n an d lawful Rule r o f the Stat e o f Brunei , i n the Islan d o f Borneo , ha s represented t o He r Britanni c Majesty' s Governmen t th e desir e of that Stat e t o b e place d unde r th e protectio n o f He r Majest y th e Queen, unde r th e condition s hereinafte r mentioned ; i t i s hereb y agreed an d declare d a s follows : ARTICLE 1 The Stat e of Brunei shall continue to be governed an d adminis tered b y th e sai d Sulta n Hashi m Jalilu l Ala m Akamadi n an d hi s successors a s an independent State , under th e protection o f Grea t Britain; but such protection shall confer n o right on Her Majesty' s Government t o interfer e wit h th e interna l administratio n o f tha t State furthe r tha n i s herei n provided . ARTICLE I I In cas e any questio n shoul d hereafte r aris e respecting th e righ t of successio n t o th e presen t o r an y futur e Rule r o f Brunei , suc h question shal l be referred t o He r Majesty' s Governmen t fo r deci sion . ARTICLE II I The relations between the Stat e of Brunei and all foreign States , including th e State s o f Sarawa k an d Nort h Borne o shal l b e con ducted b y He r Majesty' s Governmen t an d al l communication s shall be carried on exclusively through Her Majesty's Government , or i n accordanc e wit h it s directions ; an d i f an y differenc e shoul d arise betwee n th e Sulta n o f Brune i an d th e Governmen t o f an y other State , th e Sulta n o f Brune i agree s t o abid e b y th e decisio n of He r Majesty' s Government , an d t o tak e all necessary measures to giv e effect thereto . # Th e protectorat e agreement s wit h Nort h Borne o an d Sarawa k ar e almos t identical. 214 APPENDIX II I ARTICLE IV Her Majesty' s Governmen t shal l hav e th e righ t t o establis h British Consula r Officer s i n an y par t o f the Stat e o f Brunei , wh o shall receive exequaturs in the name of the Sultan of Brunei. The y shall enjo y whateve r privilege s ar e usuall y grante d t o Consula r Officers, an d the y shal l b e entitle d t o hois t th e Britis h Fla g ove r their residence s an d publi c offices . ARTICLE v British subjects, commerce , an d shipping shall, in addition to the rights, privileges, and advantage s no w secured t o them b y Treaty , be entitle d t o participat e i n an y othe r rights , privilege s an d advantages, which may be enjoyed b y the subjects, commerce, and shipping o f th e Stat e o f Brunei . ARTICLEV I No cessio n or other alienation o f any part o f the territory o f the State o f Brune i shal l b e mad e b y th e Sulta n t o an y foreig n state , or th e subject s o r citizen s thereof , withou t th e consen t o f He r Majesty's Government , bu t thi s restrictio n shal l no t appl y t o ordinary grant s o r lease s of lands o r house s t o privat e individual s for purposes of residence, agriculture, commerce or other business. ARTICLE VI I It is agreed that full and exclusive jurisdiction, civil and criminal, over Britis h subject s an d thei r propert y i n th e Stat e o f Brunei , i s reserved to Her Britannic Majesty, to be exercised by such Consula...
