Apersonsubjecttofamilyviolenceinthehomeisno lessavictimthanapersonbeatenonthesidewalkin frontofthehome.Thelawdoesnotstopatthefront doorofthefamilyhome. 05SWC.indd147 1/24/112:46:03PM 148 SudhaNair Inthelastfourteenyears,theamendmentstotheSingapore Women’s Charter have tightened the law to accord not onlymoreprotectionforvictims,butalsohelpforfamilies throughtheprovisionofcounsellingorders.Atthesame time,therehavebeeneffortstoincreasepublicawareness andinteragencynetworkinginitiativesatthemacrolevel toaddressthisproblem. In situations of family violence, the perpetrators of violencefindthemselvesinapeculiarandcontradictory situation.Intheaftermathoftheviolentact,theperpetrators ,seeingtheoutcomeoftheviolence,areforcedto confrontthetruthoftheirviciousnature.However,they invariablycannotacceptitandendupdismissingit.They areunabletomakesenseoftheirviolenceandtoplace itintermsofarealitytheycanlivewith(Eisikovitsand Buchbinder2000). Contrary to the popular notion that family violence ends in the break-up of marriages, most couples in a violent relationship in Singapore have been found to wanttosavetheirmarriages.Anevaluationstudyofthe Mandatory Counselling Programme commissioned by the Ministry of Community Development, Youth and Sports(MCYS)in2004indicatedthatsevenoutoften survivorsofviolencestatedthattheirliveshadimprovedand decidedtoremainintheirmarriagesafterundergoingthe programmes(MCYS2007a,b).Howevertherearealso instanceswherethecouplesmaydecidethemarriageis notworthsavingandendupindivorceorseparation.The law,byandlarge,hashadapositiveimpactonfamilies experiencingviolence.However,therehavebeeninstances wherethelawhashadunintendedconsequencesonthese 05SWC.indd148 1/24/112:46:03PM [18.218.169.50] Project MUSE (2024-04-19 11:46 GMT) PsychosocialImpactoftheWomen’sCharter 149 families.Whenthishappens,thefamilysuffersadditional stress. This chapter seeks to understand the impact the SingaporeWomen’sCharterhasonfamiliesexperiencing violence.Ingatheringdata,aphenomenologicalapproach, which involves understanding the situation as people experienceit,wasadopted.Inotherwords,tounderstand theimpactoflawsandpoliciesonfamiliesexperiencing violence,oneneedstounderstanditinthecontextoftheir reality.Thischapterwilldiscussaccessissuesinfamily violencecases,maintenance,andgapsinthecurrentsystem thatneedtobeaddressed.Toillustratethekeypointsinthis chapter,acasestudyanalysiswithcaseillustrationsfrom PAVe,theCentreforPromotingAlternativestoViolence, willbeused. TheSignificanceoftheAmendmentstothe Women’sCharteronSocialServicesinSingapore ThesettingupoftheFamilyCourtandtheamendmentsto theWomen’sCharterin1995and1996respectivelyturned out to be a real boon for the social services sector. For thefirsttime,socialworkerscouldreachouttotheentire familyexperiencingviolenceintheconfinesofthehome —theseincludedsurvivors,abusers,andchildwitnesses. In addition, the widening of the laws to include family membershasalsoallowedforissuesofsiblingviolence, child-to-parentabuse,andtheperpetrationofelderabuse togainattention.Thewideneddefinitionofthefamilythat goesbeyondspousesandchildrentoincludein-lawsand ex-spouses,aswellastheinclusionofpsychologicaland 05SWC.indd149 1/24/112:46:03PM 150 SudhaNair emotionalabuseinthedefinitionoffamilyviolence,allows formoremembersofthefamilytoseekprotection.
