223 18 AssistedNutritionandHydrationandthe CatholicTradition ThomasA.Shannon JamesJ.Walter TheTerriSchiavocaseinFloridafocusedattentiononavarietyofissuesrelated totheendoflife:whoisthedecisionmaker,thestatusofadvanceddirectives, theroleoffamilymemberswithrespecttomarriedadultchildren,andissues relatedtotheremovaloflifesupportsystems,particularlyassistednutritionand hydration.TerriSchiavoisnowlinkedtotwootheryoungwomenwhoplayed acriticalroleinhelpingustothinkthroughethicalissuesattheendoflife. KarenAnnQuinlanandherfamilyraisedtheissueoftheremovalofaventilator .Inhercasethephysicianswerereluctanttodothisbecausetheyfeared legalrepercussions.Thelegalandethicalanalysisconcurredthatsuchremoval wasjustifiedbecauseitconstitutedextraordinarymeansoftreatment.Nancy Cruzanandherfamilyfocusedattentionontheremovalofartificialnutrition andhydration(ANH).Againlawandethicsconcurredthatsuchremovalwas justified,particularlybecausepeopletestifiedthatbeingmaintainedinsuchcircumstances werenotherwishes. OnFebruary25,1990,TerriSchiavohadsufferedaheartattack,possibly broughtonasaresultofchemicalimbalancesfromaneatingdisorder.Shesuffered lossofoxygentoherbrainandwaseventuallydiagnosedasbeinginapersistent vegetativestate.Adecadelater,inFebruary2000,herhusbandMichael Schiavorequestedthatherfeedingtubeberemoved.TheCircuitCourtjudge agreed,andthissetoffalengthyappealandcounter-appealprocess,including attemptedlegislativeinitiativesfromthestateofFloridaandtheUnitedStates Congressandthirty-sevencourtreviews,thatwerecomplicatedbyincreasing familyacrimonyandpubliccommentaryfromavarietyofsources:religious, political,ethical,andlegal.Afterafive-yearlegalbattle,thefeedingtubewas removed,andTerriSchiavodiedonMarch31,2005,attheageofforty-one. Acriticalelementinthedebatewastheethicsoftheuseoffeedingtubes forpatientsinapersistentvegetativestate.Severalbishops,particularlyinlight ofthepapalallocationonfeedingtubesinMarch2004,arguedthattheiruse wasmorallyobligatory.ThusBishopVagaofBaker,Oregon:“Shemaywelldie inthefuturefromaninabilitytodigestfoodbutitwouldbemurdertocause herdeathbydenyingherthefoodshestillhastheabilitytodigestandwhich continuestoprovideforheradefinitebenefit—lifeitself.”1 Thatsentiment wasechoedbyRepresentativeThomasDeLayofTexaswhosaid: “Thatact ofbarbarismcanbeandmustbeprevented.”2 Acommentontheethicalissue underlyingtheprovisionofANHwasofferedbyBishopLoverdeofArlington, Virginia,whosaid:“IfMrs.Schiavowerefacingimminentdeath,orwereunable toreceivefoodandwaterwithoutharm,thenremovingnutritionandhydration wouldbemorallypermissible.Itishoweverneverpermissibletoremovefood andwatertocausedeath.Foodandwaterarebasichumanneeds,andtherefore basichumanrights.”3 AndRichardDoerflingeroftheUnitedStatesCatholic ConferenceofBishopswasreportedtohavearticulatedthenormativenature ofthispositioninaninterviewwiththeWashingtonPost: Beforethepopemadehisstatementaboutfeeding-tubecasesataconference lastyeartherewasenoughuncertaintyaboutthechurch’spositionthatCatholics couldremovefeedingtubeswithoutfearofcommittingasin.Noonecould fairlyhavesaidtoyouthatyouweredissentingfromclearCatholicteaching. Nowyouwouldhavetosay,“Yes,youare.”4 Theissueonwhichwefocusinthisnoteisthestateofthequestioninthe Catholictraditionregardingtheuseofassistednutritionandhydration,anissue thatbecamecentralinthemediaandinpublicdebate.
