53 OnFriday,March13,AlbertFallcalledonPatGarrettinhishotel room.WhenhestoppedbyGarrett’sroom,Frasermusthavebeen surprisedtoseeFallthere.AfterFraserandFallhadexchangeda fewpleasantriesabouttheweather,FraserleftsoGarrettandFall couldcontinuetheirconversation. FalltoldGarrettthathewantedhimtohaveacommissionas adeputysheriff,regardlessoftheoutcomeofthesheriff’scontest. AlthoughanobviousploytogetonGarrett’sgoodside,asitseemed hewouldinevitablybecomesheriffsoonerorlater,theincreasingly frustratedGarrettwasgladforwhateverhelphecouldget.Fallpromised togotoSantaFeandthrowhissupportbehindGarrett.1 GarrettwastoleaveforElPasolaterthatday.HetoldFraser beforeheleftthathehopedtobeplacedinofficebeforehewent outagain,sothathewouldhavethepowertoactifhesawfit. Frasernoted,“Thiswillkeepmehereuntilhegoesout,forIfail tofindanyonewhowantstogooutwithmeonthistripaloneas driverandguide....” FraseralsoobservedLeethatday.“IsawOliverLeeonthestreet hereto-day,heisnotabadlookingman,beingaDeputySheriffhe worehisbeltandpistol;hewasaroundFall’sofficeandEllis’sbarber shop.”2 FrasernextwantedtointerviewAlbertFall.Hechecked atFall’sofficethreeorfourtimesSaturdaymorning,butFallwas not in. Fraser then headed to El Paso with Llewellyn and S. B. six Assistance from Fall 54 —MurderontheWhiteSands Newcomb.TherehemetBenWilliamsforthefirsttime.Williams gaveFraserhisthoughtson“theOliverLeegang”:“Williamsis thoroughlysatisfiedthatitwastheOliverLeegangwhodidthis workandtoldmethatheknewthemwell,ashehasbeenamong themfortwoyearsandhadtoquitthembecausehewouldnotjoin themintheirmurderouswork.”Williamssaidhewasworkingto getacaseofmurderagainstLeeandothersinTexas,andsaidhe wouldbereadyinafewweekstoarrestOliverLee,“whocomes toElPasoveryoftentoseethiswomanwhorunsthefurnished roominghouse.” BenWilliamshadbeenlivinginElPasosincebeingattackedby this“gangheadedbyA.B.Fall”inLasCruces.FrasersawOliverLee severaltimesonthestreetsofElPasothatday,andobservedthat Leeworehisbeltandpistolsthere,justashedidatLasCruces. FraserstoppedatthepostofficeuponhisreturntoLasCruces Sunday. Waiting for him was a letter from Thornton.3 Thornton wroteFraserthathewoulddowhathecouldtoseethatnohitchwas madeintheefforttohavePatGarrettputinasdeputysheriff,and added,“Ifeelhowever,thatwhatIdo,shouldbedonequietly.” ThorntonthenexpressedhishopethatGarretthadtoldFraser aboutanaffidavitGarrettobtainedfromsomeonewhoonthenight ofthemurderwassupposedlystayingatahousenearthescene andsawthreehorsemen,someofthepartiessuspected,thenext morning. Thornton said of Garrett, “He said that he had some hesitancyintellingyoubecausehehadpromisedthispartythat hewouldtellnooneaboutit.ItoldGarrettthatyoumusthave thisinformationinordertoarriveatacorrectsolutionofthematter .”4 Frasernotedinhisreport,“IreceivedtwolettersfromGov.
