Abstract

This chapter discusses the usefulness of the Amendment and gaps in current succession law. The chapter discusses the invocation of Sections 1, 2, and 3, and possibility for invocation of Section 4. The existence of the Amendment also assisted the country in passing through one of its greatest tests: impeachment proceedings against a President. There have been many proposals over the past forty-five years to change the system of presidential succession. These proposals range from outright abolition of both the vice presidency and the Twenty-Fifth Amendment to modification of the system to provide for a special presidential election upon the succession of a Vice President.
