C. Wheeler, Silas Wade, John Note: The original muster roll captured by Captain Rufus Dowdy in August 1864 and presented at the court martial is almost illegible. Also, it was only partly filled out. While names and the fact that the men had entered service for three years were included, the author left out other important facts. The spaces identifying Ferguson’s colonel, regiment, and company were left blank. Even information such as when the men were last paid was left off. According to the roll, the company was formed November 19, 1862, three days after an order from Generals Bragg and Breckinridge outlawing bands of partisan rangers in Middle Tennessee. Special Orders No. 21 ordered all unattached companies to report to Breckinridge for field service. Any unauthorized groups “will be at once arrested.” It is obvious that from November 1862 on, Ferguson needed some type of documentation (legitimate or not) that would substantiate his commission and company.
